Terms of Service

These Terms of Service (“Terms”) govern your use of Cinder (the “App”), an iOS app published by Foxtide LLC (“Foxtide”, “we”, “us”). By downloading or using Cinder, you agree to these Terms.

1. What Cinder is — and is not

Cinder is a behavior-change tool that helps people quit smoking and vaping by tracking progress, providing motivation, and surfacing health-recovery information from public sources.

Cinder is not a medical device, a clinical treatment, or a substitute for professional medical advice. We do not diagnose, treat, prevent, or cure any disease. If you have a medical question or are considering nicotine replacement therapy or other medical interventions, consult a qualified healthcare professional.

2. Subscriptions and payment

Cinder offers the following purchases through Apple’s in-app purchase system:

  • Cinder Yearly — an auto-renewing annual subscription. New subscribers receive a 7-day free trial; after the trial, the subscription renews annually at the price shown in the App Store. You will not be charged during the free trial.
  • Cinder Monthly — an auto-renewing monthly subscription. There is no free trial on the monthly plan; charges begin immediately upon purchase.
  • Cinder Lifetime — a one-time, non-recurring purchase that grants permanent access to all premium features.

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the period ends. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period.

You can manage and cancel your subscription at any time in the iOS Settings app under [Your Name] → Subscriptions → Cinder Premium. Cancellation takes effect at the end of your current billing period. We do not issue prorated refunds for partial periods.

Refund requests must be submitted to Apple at reportaproblem.apple.com. Refunds are at Apple’s sole discretion.

3. License

Subject to your compliance with these Terms, Foxtide grants you a limited, non-exclusive, non-transferable, revocable license to install and use Cinder on Apple-branded devices that you own or control, for your personal, non-commercial use, in accordance with the Apple Media Services Terms and Conditions.

4. Acceptable use

You agree not to:

  • reverse-engineer, decompile, or attempt to extract source code from Cinder
  • use Cinder for any unlawful purpose
  • attempt to circumvent payment or access controls
  • impersonate another person or misrepresent your identity
  • interfere with or disrupt our servers or networks

5. Your data

How we collect, use, and protect your data is described in our Privacy Policy, which is incorporated into these Terms by reference. By using Cinder, you agree to the practices described there.

6. Disclaimers

Cinder is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that Cinder will be uninterrupted, error-free, or that any specific outcomes (such as successfully quitting smoking or vaping) will result from using the App. Your individual results depend on many factors outside our control.

7. Limitation of liability

To the fullest extent permitted by law, Foxtide LLC and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Cinder, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of Cinder will not exceed the amount you paid us in the twelve months preceding the claim.

8. Apple-required terms

You acknowledge that these Terms are between you and Foxtide LLC only, not with Apple Inc. (“Apple”), and that Apple is not responsible for Cinder or its content. Apple has no obligation to provide maintenance or support for Cinder.

In the event of any failure of Cinder to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if applicable). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Cinder.

Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

9. Termination

We may suspend or terminate your access to Cinder at any time for any reason, including violation of these Terms. You may stop using Cinder at any time and cancel your subscription as described above.

10. Governing law

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of Cinder will be resolved exclusively in the state or federal courts located in King County, Washington, and you consent to personal jurisdiction in those courts.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by an updated “Last updated” date at the top of this page. Continued use of Cinder after changes means you accept the updated Terms.
